1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the EndorVPN website (endorvpn.com), applications, and VPN services (collectively, the "Services"), operated by ReadPartner DACH GmbH, registered in Austria under registration number FN538896w ("EndorVPN," "we," "us," or "our").

By creating an account, downloading our application, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to create an account or use the Services. By using EndorVPN, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

3. Description of Services

EndorVPN provides virtual private network services that encrypt your internet traffic and mask your originating IP address by routing your connection through our servers located in various jurisdictions.

No-logs commitment: We do not monitor, log, or store information about your online activity while connected to our VPN — including browsing history, traffic content, or destination — beyond what is strictly necessary to operate the network in real time and which is not retained. Full detail is available in our Privacy Policy.

We do not guarantee that the Services will be compatible with every device, network, or use case, or that they will be available in every country (see Section 6).

4. Account Registration

To use paid features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@endorvpn.com if you suspect unauthorized use.

Automated, bulk, or bot-created accounts are not permitted and may be terminated without notice.

5. Subscriptions, Payments, and Refunds

5.1 Payment Methods

We offer payment via Stripe (card payments), NOWPayments (cryptocurrency), and Telegram Stars (within Telegram), and may add further compliant payment providers. Each processor handles the payment data relevant to that method under its own terms and privacy policy; EndorVPN does not store full card numbers or crypto wallet credentials.

5.2 Billing and Renewal

Where applicable, subscriptions renew automatically at the end of each billing period unless cancelled beforehand through your account dashboard. Prices are subject to change; we will provide advance notice of any increase before it applies to your next renewal.

5.3 Refunds

We offer a 14-day money-back guarantee on the initial purchase of a subscription. To request a refund, contact support@endorvpn.com within 14 days of your first payment.

• Refunds apply only to the initial purchase of a subscription term, not to subsequent automatic renewals.
• Refunds are issued to the original payment method where technically possible. For crypto and Telegram Stars payments a direct refund is not feasible.
• We reserve the right to decline a refund where we reasonably determine the request is fraudulent or made in violation of these Terms.
• Statutory withdrawal rights under EU/Austrian consumer law apply in addition to, and are not limited by, this policy where applicable.

6. Availability and Regional Restrictions

VPN usage is restricted or prohibited in some countries. It is your responsibility to know and comply with the laws applicable in your location. EndorVPN does not encourage use of the Services in violation of local law, and we are not responsible for consequences arising from your use of the Services in a jurisdiction where such use is restricted or prohibited.

We do not guarantee uninterrupted availability of any specific server location, and service may be affected by actions of governments or internet service providers outside our control.

7. Acceptable Use

You agree not to use the Services to:

1. Engage in any activity that is illegal under applicable local, national, or international law;
2. Access, distribute, or store child sexual abuse material (CSAM) or any related content;
3. Infringe intellectual property rights, including copyrights, trademarks, or trade secrets;
4. Distribute malware, viruses, or other malicious code;
5. Attempt to gain unauthorized access to any system, account, or network, including ours;
6. Conduct denial-of-service (DDoS) attacks, network scanning, or other activity that disrupts third-party or EndorVPN infrastructure;
7. Send spam, phishing messages, or engage in fraudulent or deceptive schemes;
8. Harass, threaten, stalk, or incite violence against others;
9. Violate the privacy of others, including sharing personal data without consent;
10. Circumvent security features, usage limits, or access restrictions of the Services;
11. Resell, sublicense, or redistribute the Services without our prior written consent.

This list is illustrative, not exhaustive. Because we do not log VPN traffic, we cannot and do not proactively monitor your activity for violations. However, we act on credible abuse reports from third parties (e.g., hosting providers, network operators, rights holders) and reserve the right to take protective action, including temporary technical measures (such as IP-level rate limiting) necessary to stop an ongoing attack, without this constituting monitoring of your traffic content.

8. Fair Use

The Services are intended for reasonable personal or business use. We reserve the right to take reasonable action, such as throttling, requesting a plan change, or account suspension, against usage patterns that are abusive or materially degrade service quality for other users. We will make reasonable efforts to contact you before taking action, except in cases of active network abuse.

9. Reporting Abuse

If you become aware of content or conduct on our network that violates these Terms or applicable law, report it to abuse@endorvpn.com, including a description of the issue and any information needed for us to investigate (e.g., timestamps, the nature of the abuse). We will review reports and take appropriate action, which may include suspending the responsible account and, where legally required, notifying authorities.

10. Intellectual Property

The EndorVPN website, application, and all related content, trademarks, and software are the property of ReadPartner DACH GmbH and its licensors, protected under applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or individual business use. You may not copy, modify, reverse-engineer, or redistribute the Services except as permitted by law or by any applicable open-source license under which parts of our software may be released.

Feedback you provide about the Services may be used by us without restriction or obligation to compensate you.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. NOTHING IN THIS SECTION LIMITS ANY WARRANTY OR RIGHT THAT CANNOT BE EXCLUDED UNDER APPLICABLE AUSTRIAN OR EU CONSUMER PROTECTION LAW.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EndorVPN and its directors, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or business opportunities, arising from your use of the Services. Our total aggregate liability for any claim shall be limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Austrian or EU law, including liability for death, personal injury caused by negligence, fraud, or gross negligence.

13. Indemnification

You agree to indemnify and hold harmless EndorVPN, its officers, employees, and affiliates from claims, damages, and reasonable expenses (including legal fees) arising from your violation of these Terms, misuse of the Services, or infringement of third-party rights, to the extent permitted by applicable law.

14. Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, governmental action, internet or power outages, or third-party infrastructure failures.

15. Termination

You may cancel your subscription at any time via your account dashboard; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraud, or created legal or security risk for EndorVPN. Termination for breach does not entitle you to a refund of prepaid fees, except as required by applicable consumer law.

16. Changes to the Services or Terms

We may update these Terms or modify, add, or remove features of the Services at any time. Material changes to these Terms will be notified in advance via email or in-app notice. Continued use of the Services after such changes constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Services and may cancel your subscription.

17. Governing Law and Disputes

These Terms are governed by the laws of Austria, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Austria, without prejudice to any mandatory consumer protection rights that entitle you to bring proceedings in the courts of your country of residence within the EU.

18. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision does not waive our right to do so later.

19. Prevailing Language

These Terms are drafted in English. Any translated version is provided for convenience only; in case of conflict, the English version prevails.
